Afaik, a bartender is not held liable for an intoxicated driver crashing into others I.e as long as the driver voluntarily took the drinks, only he’s to be held liable.
People *have* been charged in such deaths, but I don’t remember what the exact charges were. Might have been depraved indifference, or something similar. Cases like that are very difficult to prosecute, though, and holding one person or group responsible for someone else’s actions is a big gray area, legally and ethically.
Children can’t be fully responsible for their actions just because they aren’t aware of all the consequences of their actions. That’s also what the law says in most cases. If a child turns out to be a bully it is most likely due to influences and conflicts inside the family, i.e. the parents. There are also other possible factors like peer pressure, but if the children are tought early enough about empathy and what is ‘right’ that’s the best prevention of becoming a bully later on. So if you blame anyone it should be the parents who are either not willing or not competent enough to educate their children the right way. Imo this should be reflected way more in the law. Just think about it: If you’re bullied at work you can file a law suit against the bullier, but if a kid bullies other kids in school you can’t hold the parents responsible. We have to give impulses for parents to educate their children the right way, otherwise these ‘traits’ will never be defeated completely. Do you think it’s just by accident that children of violent parents turn out more aggressive and violent than the average kid? Or children of selfish and narcissist parents? Or whatever other bad characer trait you can think off; this has nothing to do with inheritance through genes, but rather through culture, education etc.
Makes you think though: The bully is only a bully because he had violent or aggressive parents, but that’s also the case with the parents who were educated by the grandparents etc. You can’t just blame anything on your education; once your old enough (say >20) YOU are held responsible for your actions because you had enough time to figure out what is ‘right’ and what isn’t.
I’ve always wondered…if someone is an adult and they bully another adult it’s assault/harassment. When it’s a child/teenager it’s just “kid’s will be kid’s” or “they’ll learn when they’re older.” I think the longer we let bullies slide the more they’ll continue doing it. A victim shouldn’t have to die in order for punishment to happen.
