What would you do next?

Hi,

So today I was almost run over because a garbage truck backed off. Before he drove back when I was behind it, the last action was that he drove forward thus making me think it is safe. He might not have seen me, but this is still his role to make sure it was clear I went to his window to get a story.

-> the police told me it is the right of the driver to do this… they did not show much concern that I was BEHIND the car at that time and that it was not clear what he was doing as a walkerby.

Then I went to the drivers door he started swinging at me, my theory now is he did this to make me step away from the door so that he could step out. As when he got out he went straight for me; I got a push in and was able made him fall on the ground. I did not punch him and only shoved as it was clear he had no good intention if he tries to get that close.
-> he claims I pulled the door open, I do not really remember but I also did not remember pushing him away from until the police arrived again (the police said that it is my story against his).
-> I do not think I pulled his door open, as that would had meant I would not had been able to have the initiate with my push, I had this because he had just stepped out and did not yet have his balance.

When he got back up he went straight for me again and I think from the punches he knew how to fight. He had a tattoo on his middle finger. A lady was shouting stop it. I was blocking some or most of his attacks but I really don’t know how long it all lasted. I was moving backwards while he moved forward; another sign of aggression and attack.
-> my glasses were on the ground about 10-15 meters further, not broken by the place where he started the assault
-> he got back in the car and still enraged I did hit the car, I think this is quite normal but then I quickly started to collect evidence as I felt he would drive off. Which he did just not far as he needed to do work in the street where he drove in too.

This guy was tall like me, but FAT. I think he knew how to fight because he got the punches in and kicked me on the knee, which untrained you cannot do as otherwise I would had been able to hurt him just as much as he did on me.
– I have a concussion
– a 8mm cut on my face
– he got a kick in on my knee, exactly at the joint. And his punches were aimed at my temple.
– the lady who saw the whole thing did not stay for the police and thus my witness disappeared…. I wonder is this not illegal? to walk away as a witness; when they know the police is on the way?

The camera are all blocked because of the size of the truck and will in no way show what truly happened except that he backed the truck up exactly when I was behind it.

When the police came it went quite quickly; he did not show concern for me, he did not ask if I am dizzy or ANYTHING (and as I said they showed NO concern for the fact that I was BEHIND the car when it backed up).

They were only focusing on what happened and telling me that it is my word against his as the police told and I had 2 options :
– shake hands and walk off
– go to the jail for 12 hours as we were both wrong (I guess speaking up to someone who could had driven over you or anyone like a child; this is why I always speak up to people like this).

Now I feel that the 2nd option was an intimidation from the police’s side; does anyone else agree with this?
So I chose for the first option, wrote the license plate down of the police officer in question and moved on. (I did not trust on receiving a fair treatment as fair would be to write a report and let the police do an investigation based on camera footage and gather testimonies of people (who had all disappeared)).

After this I spend the entire day in the hospital to get an examination; which I felt I needed as I was feeling dizzy and no doctor was available in the office to check if i might have a concussion or not.

What would you do as a next step?
1. Find him in that street and pepper spray him and leave it as that
2. File a complaint against the police and even if I did open the door;which truly is his word against mine as there is NO camera on the side where his door was & file a complaint with his company & official complaint against this man as well.
